Split Duo — Terms of Service

Last updated: September 6, 2026

The short version. Split Duo is a notebook for two people to record who paid for what. It does not hold, move, or send money, and it is not financial advice. The numbers it shows are arithmetic on what you typed in — check them before you pay anyone. It is provided as is, with no guarantee that it will be available, correct, or free of bugs. If something goes wrong, what you can recover from us is capped at what you paid us, or US$50 if that is more. Disagreements go to individual arbitration rather than court, and you have 30 days to opt out of that.

That paragraph is a summary for your convenience and is not the agreement. The sections below are.

1. Agreement to these terms

These Terms of Service (the "Terms") are a binding contract between you and Samuel Albert, an individual residing in the State of Maine, United States, doing business as Split Duo ("Split Duo", "we", "us", or "our"). They cover the Split Duo mobile app, the Split Duo website and web app, and every related service we provide (together, the "Service").

By creating an account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree to them, do not use the Service. If you are using the Service on behalf of someone else, you confirm you are authorised to accept these Terms for them.

You must be at least 13 years old to use the Service, and at least 18 (or the age of majority where you live) to make a purchase.

2. What Split Duo is — and what it is not

Split Duo is a record-keeping tool. Two people in a household enter shared expenses, and the app keeps a running tally of who owes whom.

Split Duo does not move money. Specifically:

The only money we handle is what you pay us for optional purchases, and that is handled by Apple or by our payment processor — see section 6.

3. No financial, tax, legal, or accounting advice

Everything the Service shows you — balances, splits, totals, categories, charts, reminders, suggested settle-up amounts — is arithmetic performed on data you and your household member entered. It is provided for your own convenience and is not financial, tax, legal, accounting, or investment advice, and it is not a substitute for professional advice or for your own records.

You are responsible for checking the numbers before you act on them. Before paying anyone, before relying on a balance, and before using anything from the Service in a tax filing, a legal matter, or any agreement with another person, verify it against your own receipts and statements.

4. Automatic features are best-effort and can be wrong

Some features try to read or guess things for you, including receipt itemisation and categorisation using artificial intelligence, importing receipts sent by email, detecting payments from forwarded notifications, nearby merchant suggestions, recurring-expense scheduling, and currency or date handling.

These features are best-effort and will sometimes be wrong, incomplete, or missing entirely. An AI model can misread an amount, invent a line item, or skip one. A scheduled expense can run at an unexpected time or not at all. A detected payment can be matched to the wrong expense. Treat every automatic result as a draft that you review, not as a verified fact. We are not liable for the consequences of relying on one without checking it.

5. Your account and your conduct

You keep ownership of the content you put into the Service. You grant us only the limited permission needed to operate it for you — to store your content, show it to the members of your household, back it up, and process it to provide the features you use (for example, sending a receipt image to our AI provider when you ask for itemisation). We do not sell your content and we do not use it for advertising.

6. Purchases, credits, and refunds

7. Availability, changes, and your data

We may change, suspend, or discontinue any part of the Service — or the whole Service — at any time, with or without notice. We do not promise any level of uptime, and the Service depends on third parties (hosting, database, app stores, AI providers, network operators) whose outages we do not control.

Keep your own copies of anything you cannot afford to lose. We take reasonable care with your data, but data can be lost, corrupted, or become unrecoverable, and we do not guarantee that we can restore it. The Service provides export and backup tools; using them is your responsibility.

8. Disagreements with the other member of your household

Split Duo records what you and the other member of your household enter. Any disagreement between you about who owes what, whether a payment was made, whether an expense was fair, or what to do with the household after a falling-out, is between the two of you. We are not a party to it, we will not mediate or arbitrate it, and we will not take sides, adjust balances, or delete or restore entries at one member's request in order to settle it. We are not liable for it.

9. Disclaimer of warranties

The service is provided "as is" and "as available", with all faults and without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free, that any defect will be corrected, that results or calculations obtained from it will be accurate or reliable, or that your data will not be lost. No advice or information, whether oral or written, obtained from us or through the Service creates any warranty not expressly stated here.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. In that case such warranties are limited to the shortest period permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, goodwill, business, or data, arising out of or relating to these Terms or the Service — whether the claim is based in contract, warranty, tort (including negligence), strict liability, statute, or any other theory, and even if we have been advised of the possibility of such damages.

Without limiting that, we are not liable for money you pay or fail to pay to anyone, for an incorrect balance, split, total, or automatic result, for a payment made to the wrong person or in the wrong amount, for a missed reminder or notification, for lost, corrupted, or unrecoverable data, for any dispute between you and the other member of your household, or for the acts, omissions, outages, or terms of any third-party service.

Our total aggregate liability for all claims relating to the service will not exceed the greater of (a) the total amount you actually paid us in the twelve months before the event giving rise to the claim, or (b) fifty United States dollars (US$50).

These limits apply even if a remedy fails of its essential purpose, and they reflect a reasonable allocation of risk that forms an essential basis of this agreement — the Service is offered on these terms and would not be offered without them. Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you; nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Samuel Albert and anyone working on Split Duo from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or relating to: your use of the Service; content you submit to it; your breach of these Terms or of any law; your violation of anyone else's rights; or any dispute between you and the other member of your household. We may take over the defence of any such claim at your expense, and you will not settle it in a way that imposes any obligation on us without our written consent.

12. Suspension and termination

You may stop using the Service at any time and can permanently delete your account from Settings → Delete account. We may suspend or terminate your access at any time, including if we believe you have breached these Terms or if we discontinue the Service. Sections that by their nature should survive termination do survive it — including sections 3, 8, 9, 10, 11, 13, and 14.

13. Governing law

These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Maine, United States, without regard to its conflict-of-laws rules, and by applicable United States federal law (including the Federal Arbitration Act). Subject to section 14, the state and federal courts located in Maine have exclusive jurisdiction, and you consent to their jurisdiction and venue. Nothing here deprives you of the protection of mandatory consumer-protection laws of the country where you live.

14. Disputes: informal resolution, then individual arbitration

Please read this section carefully — it affects how disputes are resolved.

Talk to us first. Before starting any formal proceeding, email legal@splitduo.app describing the problem and what you would like us to do. Most issues are settled this way. Neither of us may start arbitration until 60 days after that email, and that period is a condition of bringing a claim.

Binding individual arbitration. If we cannot resolve it informally, you and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, before a single arbitrator. The arbitration may proceed on documents alone, by phone, or by video; any in-person hearing will take place in Maine or in the county where you live, whichever you prefer. The arbitrator decides the dispute and may award the same individual relief a court could. Judgment on the award may be entered in any court with jurisdiction.

Class action and jury waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. You and we each waive any right to a jury trial. If this paragraph is found unenforceable as to a particular claim or request for relief, that claim or request is severed and heard in the courts identified in section 13, while everything else remains in arbitration.

Small claims. Either of us may instead bring an individual claim in small-claims court if it qualifies.

Your right to opt out. You may reject this section 14 by emailing legal@splitduo.app within 30 days of first accepting these Terms, with the subject line "Arbitration opt-out" and stating the email address on your account. Opting out costs you nothing, changes nothing else about your use of the Service, and does not affect any prior agreement. If you opt out, disputes go to the courts named in section 13 instead.

Unless the law says otherwise, any claim must be brought within one year after it arises, or it is permanently barred.

15. Apple App Store

If you use the iOS app, the following also applies and Apple requires that we state it:

To the extent any Apple Standard End User Licence Agreement applies to the app, these Terms supplement it, and these Terms govern to the extent of any conflict, except where Apple's terms must prevail.

16. Changes to these Terms

We may update these Terms. When we do, we will change the date at the top of this page, and for material changes we will make a reasonable effort to tell you in the app or by email. Continuing to use the Service after a change means you accept the updated Terms; if you do not accept them, stop using the Service and delete your account. A change to section 14 does not apply to a dispute we were already notified of before the change.
